Welcome to Hermes Yachting‘s Sailing Yacht Charter Terms and Conditions!

These terms and conditions are designed to ensure a safe, enjoyable, and unforgettable voyage for all our guests. We recommend that you carefully read and understand the following information, as it outlines the guidelines and responsibilities that both you and Hermes Yachting will uphold throughout your charter experience.

Your satisfaction and safety are our top priorities, and by adhering to these terms and conditions, we aim to provide you with a seamless and memorable sailing adventure.

Terms & Conditions

Charter rates are in Euro(€), refer to the weekly charter period & include

A 50% discounted VAT at the current rate of 12% (from the full 24% VAT rate). This is conditional upon the skipper returning a stamped declaration from the port authorities, verifying arrival at a port more than 6nm from the initial embarkation point.

Access to yachts equipped with VHF, Radio CD, GPS, Autopilot, Echo sounder, Speedometer, Dinghy, Warm water supply, Sprayhood, Bimini/tent, and Blankets

Charter rates do not include

o  Fuel, water, provisioning, extra linen running expenses & mooring fees
o  Provisions: Upon request
o  Transfer services from the Airport to the Base: Upon request

End Cleaning (not commissionable, payable at the base in cash): cleaning, cooking gas, Water, Linen (2 sheets, 1 pillowcase, 2 bath towels per person per week, mooring fees at Olympic Marina for the duration of the charter):

Embarkation / Disembarkation

Embarkation: charter period start date from 17:00
Disembarkation: charter period end date by 09:00
Return to re-delivery Base – Compulsory: return to base the evening before disembarkation, 17:00 at the latest.
Check-in/out procedure time is part of the charter period.

Extras’ Payment Terms

Items designated with an asterisk (*)—such as end cleanings, crew arrangements, and optional equipment, extras & services—provided by independent vendors must be paid in full by the Charterer, in cash, before embarkation at the designated base.

Discounts

o  Internet Discount: 30%
o  Multiple weeks charter: 5%
o  Repeat Client Discount: 5%

Security Deposit

Before embarkation, the Charterer will deliver at Charter Base a Security Deposit of such amount as listed on the pricelist and confirmed by the offering statement. Cash payment and credit cards (VISA or MasterCard) are accepted. Debit cards & AMEX are not accepted.

The Security Deposit is non-commissionable and applicable per insured event (damage or loss). Should an incident covered by the Security Deposit occur during the charter, the Charterer must replenish the Security Deposit to the initial amount to continue the charter, having sufficient coverage for any other incident. In any other case, the Stakeholder and/ or Owner retain the right to treat the charter agreement as having been breached by the Charterer and end the charter.

*The Damage Waiver serves to reduce your financial responsibility in the event of impairment to the yacht, deterioration or loss of supplementary equipment, or harm incurred through third-party actions during the duration of your charter agreement. This waiver is non-refundable and provides comprehensive coverage for any loss, accident, or damage affecting the yacht, its equipment, or any third parties. This includes all risks stemming from negligence or malicious actions, whether perpetrated by the skipper or the chartering clients and offers full indemnification in all such scenarios.
For charters facilitated by Hermes Yachting that involve a skipper, only an insurance deposit of 350€ is obligatory, and no Refundable Security Deposit is required. However, please note that the refundable deposit will be forfeited skippered charters in instances involving the loss of tender or outboard components, or incidents of clogged sanitation systems.

Exclusions from Charter Rates

Charter Expenses
Not covered end cleaning, fuel and water consumption, berthing and canal fees, provisioning, and additional charterer’s expenses.

Special Arrangements
Airport pickups, transfers, early check-in, and advance provisioning are not included.

Insurance
Traveler’s insurance, trip cancellation or curtailment, personal items, and skipper’s liability are excluded.

Crew
Costs for skipper and hostess are not included.

Optional Extras
Water toys, special equipment, or services listed as extras are not part of the charter rates.

Prices

o  All prices are in euros (€) and are subject to change without prior notice.
o  Charter Prices are inclusive of local taxes and currently applicable VAT (12% on charter fee), which may change without the liability of the Broker, Stakeholder, or Owner.
o  In the event of legislative changes affecting VAT post-booking, any resulting adjustments to the total due will be credited or debited to the Charterer accordingly.

Payments

Down payment
30% down payment (of the total charter fee, depending on the booking date) is paid by the bank’s transfer to our account upon contract signing/booking confirmation.

Balance payment
70% final payment 45 days before embarkation.

o  Failure to Complete Balance: If the balance payment is not received by the due date, as specified in the booking confirmation, and the absence of any prior notification from the client or the agency, Hermes Yachting P.C. reserves the right to unilaterally cancel the charter agreement. Under such circumstances, all advance payments made will be non-refundable.
o  Payment Methods: Clients have the option to remit the down payment via wire transfer, which incurs no additional surcharge, or through an online credit card payment, subject to applicable credit card fees. This initial deposit should be finalized within one week following the issuance of the booking confirmation to secure the reservation.
o  By adhering to these payment terms, clients ensure a seamless booking and chartering experience with Hermes Yachting P.C.

Booking Confirmation Terms

Availability is not guaranteed until a booking is formally confirmed under the following terms:
o  Options may be held upon request for up to 3 days.

A booking with Hermes Yachting is confirmed and legally binding only when:
o  A duly signed Reservation Form / Charter contract has been submitted, and
o  The initial payment has cleared in Hermes Yachting’s bank account within the specified deadlines in the booking agreement.

Hermes Yachting reserves the right to consider any booking as cancelled by the Charterer, without liability or prior notice, if required documentation and/or payments are not submitted by the deadlines and terms specified in the booking agreement.

Cancellation Policy

In case the client needs to cancel the booking, the following terms apply:
o  For bookings cancelled up to 46 days before embarkation, 30% of the total charter fee.
o  For bookings cancelled less than 45 days before embarkation, 100% of the total charter fee.
o  No show / withhold of every paid amount.

Changes in Booking

Each reservation is tied to a specific yacht. Hermes Yachting reserves the right to make changes by reassigning bookings to another yacht at any time before the charter start date. Such changes are subject to written confirmation and the substituted yacht must be of equal or superior type, model, age, equipment, and specifications.

Sailing Qualifications

For Skippered or Crewed Charters: No licensing is required for clients opting for skippered or crewed charters.

For Bareboat Charters:
Mandatory Requirements: One certified sailing yacht skipper and at least one experienced crew member, both aged over 18, are required.
Language: All certifications must be in English.
Skills: Skippers must demonstrate competence in navigation, anchoring, berthing, mooring, and handling a yacht under various conditions.

Accepted Certifications:
o  International Certificate of Competence (ICC SAIL)
o  International Proficiency Certificate (IPC), America
o  USA-US Sailing “Bareboat Cruising Course,” ASA “104 Bareboat Cruising Course”
o  NauticEd SLC (International)
o  Germany – Sportbootführerschein See
o  Belgium – Algemeen Stuurbrevet
o  France – LE PERMIS PLAISANCE
Other nationally recognized sailing certificates may also be accepted, subject to verification by local Port Authorities.

Exclusions:
Certificates will be rejected if they are limited to:

Inland or coastal waters (<20nm)

Powerboats/motor yachts only

Yachts smaller than the chartered vessel

Submit copies of all sailing certificates to Hermes Yachting at least two weeks before the charter. Originals will be required upon arrival.

Liability & Compliance:
Charterer is solely responsible for the validity of their qualifications. Hermes Yachting and the Broker disclaim liability for any certificate rejection by local authorities. Non-compliance may result in the hiring of a professional skipper at the Charterer’s expense or termination of the charter agreement.

Offer Conditions

Yacht specifications and equipment may differ from what is presented in promotional materials or online. Only details provided in Hermes Yachting’s specific offer in response to each inquiry are considered valid. Promotional content, such as information sheets, brochures, and online photos/videos are indicative in nature and not contractually binding.

Hermes Yachting strives for accuracy in updating its booking calendar and yacht details across platforms. Despite these efforts, the possibility of incomplete or incorrect content exists. Specifically, prices and other information are subject to potential typographical or programming errors; these errors do not constitute a binding agreement.

In any Charter Agreement, individuals allowed aboard by the Charterer are deemed to be the Charterer’s agents. Hermes Yachting will only engage with the Broker and the Charterer, who will be the primary contact for all correspondence, including changes, amendments, and cancellations.

Yacht Insurance Terms

o  All yachts are insured in compliance with Port State regulations, covering accidental damage, including damage to third parties. The insurance encompasses Yacht Hull, Machinery, and Equipment as well as Third Party Liability.
o  The insurance does not cover theft or loss of personal belongings onboard or accidents involving charter travellers.
o  Events arising from willful misuse, gross negligence, fraudulent behaviour, illegal activity, or breach of charter terms may not be covered by the insurance. This includes unpaid repair, refuelling, or berth dues.
o  The insurance carries a deductible per insurable event; therefore, an excess security deposit is required from the Charterer.

Complaints

o  Clients dissatisfied with Hermes Yachting P.C.’s services must submit a written complaint, accompanied by all pertinent documentation, to charter@hermesyachting.com within 24 hours of vessel check-out to be eligible for potential compensation.
o  Complaints submitted after the 24-hour deadline or lacking proper documentation may not be considered and could void any rights under the Charter Contract.
o  Hermes Yachting P.C. will issue a written response within 14 days of receiving a valid complaint. An additional 14-day extension may be utilized for a thorough investigation.
o  The maximum compensation for any complaint is limited to the value of the affected service portion and will not encompass the already-utilized charter period or total Charter Fee.

Broker Commissions

o  The official Hermes Yachting pricelist includes an Agent’s commission of 10-20% calculated on the charter fee net of VAT.
o  Non-Commissionable Items: Optional and compulsory extras, as well as additional services, are not subject to commission.

Commission Eligibility:

Fully Executed Charters
The commission is considered earned once the charter is fully executed, and no refund is due to the charterer.

Partial Refunds
If the charterer is eligible for a refund as per Hermes Yachting’s terms, the commission will be retained on a pro-rata basis.

Cancellations
In case of charter cancellation or curtailment, the commission will be adjusted on a pro-rata basis.

Invoicing
Agent Commission Invoices should be issued to the Yacht Owner company (details to be provided) one month before the charter. Bookings from EU-based businesses are accepted only if they have a mandatory VIES-registered VAT number.
